1.  INTRODUCTION 

 

Welcome to the Internet site (“Site”) controlled, operated and administered by Go Sales Licensing US Inc. ("Go Sales", "our", "we" or “us”). Go Sales operates under certain brand names and branded services including Go2Wireless, Get Online Mobility, and Go2Security. We are independently owned and operated Authorized AT&T dealer and an affiliate partner of an Authorized ADT dealer. 

This Site contains text, images, graphics, audio, video, data, design, interactive features and other information (collectively, the "Content") and certain services available through or in connection with our Site marketing, promoting and/or offering products and services for purchase or subscription (“Services”). 

 

PLEASE READ THESE TERMS OF USE CAREFULLY.  By accessing or using our Site in any way, you agree to comply with these Terms of Use, including our Privacy Policy (collectively referred to as the "Terms"). If you do not agree to these Terms, do not use the Site, the Content or the Services. 

 

If you wish to subscribe or purchase telecommunication and electronic security products or services offered by Go Sales, such products or services will have their own terms and conditions that apply to your purchase or use of those particular products or services. The Terms do not alter in any way the terms or conditions of any of these other written or online terms and conditions or agreements you may have or will enter into with third parties who provide the products and services you request, including their website terms of use and privacy policies. To the extent that there is any conflict between these Terms and any terms and conditions or agreements relating to the products and services you have purchased or online tools you use or to which you subscribe, those other terms and conditions or agreements will govern. 

 

2.  AUTHORITY 

 

By using our Site or Services, you represent that you are at least 13 years old. Persons who are at least 13 years of age but under the age of 18 may only use our Sites or Services with legal parental or guardian consent. Accordingly, you agree that you are at least 18 years of age or older or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, representations and warranties set forth in the Terms; otherwise, please exit the Site.   

 

3.  CHANGES TO THE TERMS OR SITE 

We reserve the right, at our discretion, to change or modify portions of these Terms at any time without notice other than posting the amended Terms on the Site. The amended Terms will automatically be effective when posted on our Site. Your continued use of our Site after any changes to these Terms shall constitute your consent to such changes.  

  

4.  REGISTRATION, PASSWORD AND SECURITY 

Whenever you provide us with information on our Site or in connection with our Services, you agree to provide true, accurate, current and complete information. If you provide any information that is, or we have reasonable grounds to suspect that the information is, untrue, inaccurate, not current or incomplete, Go Sales may without notice terminate your use of our Site and refuse to provide any Services. 

If you decide to purchase or subscribe to products or services offered by Go Sales, you will be asked to create a password-protected account and will be required to provide certain personal information, including, but not limited to, name, email address, mailing address, telephone number(s), billing and payment data, and/or products and services purchased by you. You are solely responsible for maintaining the confidentiality of your account information. You are also responsible for all activities that occur in connection with your account, irrespective of whether you personally engage in such activities. You agree to notify us immediately in the event of any known or suspected unauthorized use of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password. Go Sales is not liable for any unauthorized disclosure of your personal information that results from your failure to adequately protect your account information.  

 

THERE IS NO SUCH THING AS "PERFECT" SECURITY ONLINE. While there is no such thing as "perfect security" on the internet, we will take reasonable steps to ensure the safety of your personally identifying information. However, you understand and agree that such steps do not guarantee that use of the Site is invulnerable to all security breaches, and that Go Sales makes no warranty, guarantee, or representation that use of any of our Site is protected from viruses, security threats or other vulnerabilities. If at any time you are asked for personally- identifiable Information you do not wish to be disclosed, you should terminate your use of the Site, the consultation with Go Sales representative, the transaction or cancel your account registration immediately.  

 

5.  PRIVACY POLICY 

 

Go Sales’ collection and use of your personal information through or in connection with our Site or our Services is governed at all times by our Privacy Policy, which is incorporated into these Terms. You understand that through or in connection with the use of our Site or Services you consent to the collection and use of this information.  

 

6. EXTERNAL LINKS 

Go Sales may include links to other websites. Such links do not imply an endorsement of the materials disseminated at those websites, nor does the existence of a link to another site imply that the organization or person publishing at that site endorses any of the materials at Go Sales. Go Sales is not responsible for the materials contained at any website linked to or from Go Sales.  

 

7.  INTELLECTUAL PROPERTY  

 

Trademarks (including but not limited to the Go Sales logo) that are used or displayed on the Site and the Content are owned by Go Sales, or by third parties other than Go Sales that provide software, products and services on or through the Site or Services. The trademarks may not be copied or used, in whole, partial or modified form, without the prior written permission of Go Sales Holdings Ltd. or, if applicable, its licensor. In addition, Go Sales custom graphics, logos, button icons, scripts, and page headers are covered by applicable trademark, trade dress, copyright or other proprietary right law, and may not be copied, imitated, or used, in whole, partial or modified form, without the prior written permission of Go Sales.  

 

8.  COPYRIGHT COMPLAINTS 

 

Go Sales respects the intellectual property rights of others. Pursuant to the Digital Millennium Copyright Act of 1998 (the “DMCA”), under 17 U.S.C. §§ 512(b)–(d), a copyright holder may send Go Sales a valid notification of claimed copyright infringement under the DMCA if they believe that their work has been copied and has been posted, stored, or transmitted to the Sites in a way that constitutes copyright infringement. 9. ACCEPTABLE USE 

 

You agree to use our Site and its Content, as well as any software provided in connection with our Services, in a manner consistent with all applicable laws and regulations. Additionally, you will not take any of the following actions with respect to our Site, Content, Services or related software: 

1. impersonate any person or entity or falsely state or otherwise misrepresent yourself;  
2. solicit, collect or post personal data or attempt to solicit, collect or post personal data from third parties who have not given their consent;  
3. access or attempt to access another user’s account without his or her consent;  
4. conduct yourself or submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, motivated by animosity toward another person’s race, ethnicity, gender identity, sexuality, religion or other personal characteristic, or is otherwise objectionable (in Go Sales’ sole discretion)  
5. submit content that infringes in any manner on the copyright, trademark or other intellectual property rights of any person or entity;  
6. submit content that contains any confidential or proprietary information of any person or entity, or that otherwise violates the legal rights of any person or entity;  
7. submit content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any software, hardware, network, server or communications systems or equipment; or  
8. reverse engineer, decompile, data mine, record, "scrape," link to, collect information or otherwise manipulate content from the Site or software; and/or 
9. copy, reproduce, modify, publish, transmit, link, solicit, display or exploit, the Site or the Content, in whole or in part, without Go Sales’ consent. 

10. GEOGRAPHICAL RESTRICTIONS 

 

Go Sales provides this Site for use only by persons located within the United States. Go Sales makes no representation that all products, services and/or material described on the Site or through our Services are appropriate or available for use in all territories within the United States. 

 

11.  DISCLAIMER OF WARRANTIES 

 

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:   

1. YOUR USE OF OUR SITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN THE SITE, AND OUR SERVICES IS AT YOUR SOLE RISK. OUR SITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN THE SITE AND OURS SERVICES, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.  GO SALES, ITS SUPPLIERS AND LICENSORS AND OTHER RELATED PARTIES, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, SERVICE PROVIDERS, SUPPLIERS, AGENTS AND REPRESENTATIVES (”GO SALES PARTIES”) EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, STATUTORY OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OF DATA AND NON-INFRINGEMENT. BECAUSE SOME JURISDICTIONS MAY NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.  
2. GO SALES PARTIES MAKE NO WARRANTY THAT:  (i) OUR SITE OR SITE- RELATED SERVICES WILL MEET YOUR REQUIREMENTS; (ii) OUR SITE WILL BE UNINTERRUPTED, ACCURATE, TIMELY, SECURE (INCLUDING FREE FROM UNAUTHORIZED ACCESS), RELIABLE OR ERROR-FREE; (iii) AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION, MATERIALS, PRODUCTS OR SERVICES OFFERED, PROVIDED OR ADVERTISED THROUGH THE SITE OR SERVICES; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH OUR SITE OR SERVICES WILL MEET YOUR EXPECTATIONS; AND (vi) ANY ERRORS IN OUR SITE WILL BE CORRECTED. 
3. GO SALES DOES NOT WARRANT, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE DISCUSSED, PROMOTED, ADVERTISED, OR SOLD THROUGH THE SITE OR SERVICES. UNDER NO CIRCUMSTANCES SHALL GO SALES PARTIES BE HELD LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON SUCH INFORMATION. IN NO EVENT SHALL GO SALES PARTIES BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH: (i) THE USE OR INABILITY TO USE THE SITE OR THE CONTENT, MATERIALS, INFORMATION OR TRANSACTIONS PROVIDED ON OR THROUGH THE SITE OR SERVICES; (ii) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SITE OR THE CONTENT, MATERIALS, INFORMATION, PRODUCTS, OR SERVICES ON OR AVAILABLE THROUGH THE SITE OR SERVICES; (iii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY PRODUCTS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM OUR SITE OR SERVICES; (iv) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR OR OUR THIRD PARTY’S SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (v) ANY BUGS, SPIDERS, ROBOTS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO, THROUGH OR BY THE SITE, AND/OR; OR (vi) ANY OTHER MATTER RELATING TO OUR SITE, EVEN IF GO SALES OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR SERVICES IS TO STOP USING THE SITE AND/OR THOSE SERVICES. 
 
APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY, IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU.  IF ANY PART OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE, THEN THE AGGREGATE LIABILITY OF GO SALES UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). 

 

13. TERMINATION 

 

You acknowledge and agree that Go Sales, in its sole and absolute discretion, may, without notice to you, terminate your use of, or access to, the Site or our Services, including where Go Sales believes that you have violated any of these Terms.  

 

14. MISCELLANEOUS 

 

1. Entire Agreement. These Terms sets forth the entire agreement between you and Go Sales relating to the subject matter hereof and supersede any prior agreements of any kind or nature with regards to such subject matter.  
2. Governing Law. These Terms shall be governed and construed in accordance with the laws of the State of Texas applicable to agreements made and to be performed in Texas. You agree that any legal action or proceeding between Go Sales and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Texas.  
3. Disputes Resolution. If you have any concern or dispute about the Site or our Services, you agree to first resolve the dispute informally by contacting Go Sales.  
4. General.  Go Sales may assign its rights and duties under this Agreement to any party at any time without notice to you. Your rights and duties under these Terms are not assignable by you without written consent of Go Sales. Nothing in these Terms of Use shall be deemed to confer any third-party rights or benefits. Go Sales's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions.
